Role Overview

Fisker Group Inc is currently seeking a Senior Counsel, Automotive Sales & Marketing, to join our Legal team! In this role, you will support Fisker’s expansion through its transition to the dealership partner model. With a commitment to innovation, customer satisfaction, and sustainable business practices, we are seeking a highly skilled and experienced automotive counsel to join our legal team. In this role, you will play a crucial role in shaping the legal landscape of our company’s dealer network. Your primary responsibility will be to provide strategic legal counsel and support to our dealer development initiatives, ensuring compliance with applicable laws and regulations while fostering positive relationships with our network of automotive dealers. The position will interact with and advise team members at all levels of the Company, including top executives. As an integral part of the team, the Automotive Counsel will proactively assess legal risks and advise on decisions that will provide years of benefit to the overall organization.

Responsibilities

  • Provide focused, commercial, practical, and compliant advice on a wide range of legal matters, including dealership engagement, dealership licensing and agreements, on-boarding, and dealer to consumer sales, after sales and marketing matters.

  • Stay abreast of federal, state and local laws and regulations affecting automotive dealer operations.

  • Develop and implement compliance strategies to ensure all dealer development activities adhere to legal requirements.

  • Be a trusted business partner providing practical advice to reduce risk while accomplishing Fisker’s goals.

  • Support the business in understanding and complying with State and regulatory requirements.

  • Oversee and submit filings for required business licensing related to the transition to the dealer partner model.

  • Serve as lead counsel to Fisker’s Fleet and Commercial Sales organization and counsel regarding all operational issues, including dealer franchise matters, marketing campaigns, advertising and marketing issues.

  • Draft marketing and sponsorship agreements, sales contracts, exclusivity and site control agreements, settlement agreements, exercise of right of first refusal contracts, and other dealer franchise-related agreements.

  • Counsel on a variety of ongoing projects related to public relations, communications, marketing and advertising.

  • Advise on sales and distribution issues, including franchise/dealer issues, anti-trust issues.

  • Consult with Fisker’s leadership team regarding dealer franchise network strategies and plans.

  • Advise the business on claims, disputes, and litigation.

  • Draft, review, and negotiate a variety of contracts of all types, including vendor, sponsorship, consulting, marketing, licensing, technology, privacy, facility/building leases and other agreements.

  • Draft and update model standard templates and clauses.

  • Develop contract review processes to enhance efficiencies.

  • Responsible for providing legal counsel and guidance to all levels of the Company, including executive management.

  • Manage contracts with external partners and advise on enforcement and disputes.

  • Manage external law firms for specialized legal advice while administering and managing company’s budget.

Basic Qualifications / Knowledge / Experience

  • Minimum 10 years of progressively responsible experience in the automotive industry, with 5+ years preferably with an automotive OEM or with a law firm with an area of automotive practice specialty

  • Juris Doctor (JD) degree from an accredited law school

  • Admission to bar in relevant jurisdiction

  • Experience in establishing a North America OEM and dealership engagement.

  • Strong knowledge of relevant laws and regulations affecting automotive dealerships.

  • Dynamic personality, and highly team-oriented approach to work

  • Strong work ethic

  • Excellent interpersonal and communication skills.

  • Self-starter with high levels of initiative and experience of working with limited supervision.

  • Qualified to practice law in North America with 8-10 years of commercial experience.

  • Completed your training and post-qualification experience at a reputable law firm or in-house team.

  • OEM/Dealership law expertise and, ideally, expertise in corporate, advertising, regulatory matters, data protection, intellectual property, technology and/or employment law

  • Expertise in drafting, negotiating, and interpreting contract terms and condition.

Expected Salary Range : $ 126,456.00 - $ 211,095.60 per annum.

Additional compensation : Salary is one part of total compensation which includes bonuses, equity awards as applicable, and benefits. An employee is eligible to participate in Fisker’s equity program, subject to the rules governing such programs.

Benefits: Fisker provides comprehensive medical, prescription, dental, vision, and disability insurance packages for full-time employees, their spouse or domestic partner, and children up to age 26. Coverage is effective on the first day of employment, and Fisker covers most of the premiums for employees.

The salary offered may vary depending on multiple individualized factors including market location, job-related knowledge, education/training, certifications, key skills, experience, internal peer equity as well as business considerations. Fisker reasonably and in good faith expects to pay for the position within the salary range listed, taking into account the wide variety of factors listed above.
